1. These terms
By ordering from this site you agree to what follows. If you do not agree, do not order. We may update these terms; the version in force is whatever is published here when you place your order.
2. Orders
An order is an offer to buy. We accept it when we ship. If we cannot fulfil an order — stock, a pricing error, or an address we cannot ship to — we will cancel it and refund in full.
We reserve the right to refuse or limit an order, including where quantity suggests resale.
3. Prices
All prices are in US dollars and exclude tax, which is calculated at checkout based on your shipping address. Prices can change without notice, but never after you have placed an order.
If a product is listed at an obviously wrong price, we may cancel the order and refund you, even after confirmation.
4. Shipping and risk
Delivery estimates are estimates, not guarantees. Risk of loss passes to you on delivery. If a carrier loses a parcel, that is our problem to solve, not yours — tell us and we will replace or refund it.
5. Returns
Our returns policy forms part of these terms. Forty-five days, prepaid label, full refund. Gift cards are not returnable.
6. Warranty
Products carry a 2-year limited warranty from delivery, covering manufacturing defects in heating elements, batteries, controllers, wiring and seams. It does not cover normal wear, misuse, or loss. Our liability under it is limited to repair, replacement or refund, at our discretion.
7. Safe use
These products contain lithium batteries and heating elements. You agree to follow the instructions supplied, and specifically: do not charge a damaged or swollen battery, do not sleep on a heated product, do not use it on someone who cannot sense heat or move away from it unaided, and do not modify the electronics. We are not liable for injury or damage resulting from use contrary to those instructions.
8. Gift cards
Gift cards never expire, carry no fees, cannot be redeemed for cash except where law requires, and are not replaceable if the code is lost or shared.
9. Intellectual property
The Benchies name, logo, product designs, site text and images belong to us. You may not reproduce them commercially without written permission.
10. Limitation of liability
To the fullest extent the law allows, our total liability for any claim arising from a purchase is limited to the amount you paid for the product in question. We are not liable for indirect or consequential loss. Nothing here limits liability for death or personal injury caused by our negligence, or for fraud.
11. Governing law
These terms are governed by the laws of the State of Minnesota, and the courts of Hennepin County have exclusive jurisdiction.
